1. Acceptance of Terms

By accessing or using the AzenCare platform, website, or mobile application (“Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. These Terms apply to all users, including clients, therapists, and visitors. If you do not agree, do not use the Service.

2. Description of Service

AzenCare is a two-sided therapy marketplace that connects families, adults, seniors, and caregivers (“Clients”) with licensed Occupational Therapists (OT), Physical Therapists (PT), and Speech-Language Pathologists (SLP) (“Therapists”) for in-person and telehealth sessions. AzenCare is a technology platform and is not a healthcare provider.

3. User Eligibility

• You must be at least 18 years old to create an account. Parents or legal guardians may create accounts on behalf of minors.
• Therapists must hold a valid, current license in their discipline (OT, PT, or SLP) in the applicable jurisdiction.
• You must provide accurate, complete, and current information during registration.

4. Therapist Credentialing

Therapists joining AzenCare must submit proof of licensure and credentials for verification. AzenCare verifies credentials in good faith but does not guarantee the accuracy of information provided by Therapists. Clients are encouraged to independently verify a Therapist’s credentials before booking. AzenCare reserves the right to suspend or remove any Therapist profile at any time.

5. Payments & Fees

• All payments are processed through Stripe. By using the Service, you agree to Stripe’s Terms of Service.
• Session rates are set by individual Therapists. AzenCare may charge a platform fee.
• Refunds and cancellation policies are subject to the individual Therapist’s policy and AzenCare’s dispute resolution process.
• Therapists are paid weekly via Stripe Connect. Payment timelines may vary.

6. Prohibited Conduct

You agree not to:

• Provide false, misleading, or fraudulent information
• Practice therapy without a valid license
• Harass, abuse, or harm other users
• Use the Service for any unlawful purpose
• Attempt to circumvent platform payment systems
• Scrape, copy, or reproduce any part of the Service without permission

7. Limitation of Liability

AzenCare is a marketplace platform and is not responsible for the quality, safety, legality, or appropriateness of therapy services provided by Therapists. To the fullest extent permitted by law, AzenCare LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

8. Intellectual Property

The AzenCare name, logo, and all associated trademarks are the property of AzenCare LLC (USPTO™). All content, features, and functionality of the Service are owned by AzenCare LLC and protected by applicable copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding without prior written permission.

9. Termination

AzenCare reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, AzenCare, or third parties. You may close your account at any time by contacting hello@azencare.com.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in New York County, New York.
